Important information about your rental
On arrival you will be required to sign a rental agreement with the operators of Enviro Wohnmobil. Here is a summary of the terms and conditions:

Definitions
The following definitions apply for the Terms and Conditions for Enviro Wohnmobil.

-  The Supplier means the operator of Enviro Wohnmobil.
-  The Client is also referred to as the hirer (s)

General rental conditions for renting a motorhome  - Valid from 01 January 2008

The rent depots – hereinafter referred to as the "Lessor" – offer motorhomes on the terms and conditions set forth below Please read these general terms and conditions through carefully!
1. Applicable Law, Position of the Customer, Content of the Agreement
1.1 The object of the Agreement is exclusively the rental of the motorhome.
1.2 A Rental Agreement is reached between Lessor and the Lessee, which is subject exclusively to German law, namely, primarily the provisions of this Agreement – and in an auxiliary capacity the statutory regulations relating to the Rental Agreement.
1.3 The Lessee organises his journey himself and is personally responsible for his use of the vehicle. The Lessor owes no obligation to render travel services and, in particular, he owes no obligation to render a body of travel services. The statutory provisions relating to package holiday agreements, in particular §§ 651a-l German Civil Code (BGB), do not apply to the contractual relationship, either directly or mutatis mutandis.
1.4 The Collection and Return Report to be completed in full and signed by the Lessee and the collection depot also forms an integral part of the Rental Agreement.
1.5 Multiple Lessees are jointly and severally liable.

2. Minimum Age, Driving Licence
The rented object may be driven only by Lessees or other authorized drivers who are over 21 years of age and have a respective driving licence. A class 3 driving licence is adequate for all models. Holders of class B driving licences are authorized solely to drive vehicles with a maximum permitted laden mass of up to 3,500 kg. Holders of class C1 driving licences are authorized to drive vehicles with over 3,500 kg maximum permitted laden mass. Holders of class B and C1 driving licences must have held the driving licence for a minimum of 1 year. The rented object will be handed over only if the respective preconditions are shown to be met and the driving licence is presented. This does not affect the obligation to pay the agreed rental fee.

3. Rental Charges, Insurance
3.1 Rental charges are based on the prices given in the price list valid at the time the Agreement is concluded, unless a special price has been agreed and the rental price agreement is based on an  obvious error. The different seasonal periods are taken into consideration in the price calculation.
3.2 The rental charges include: Part comprehensive cover with a maximum excess amount of € 1,000 and fully comprehensive cover with a maximum excess amount of € 3,000 per claim. Liability insurance towards third parties with up to € 50 million cover for property damage and financial loss, for personal injury with € 8 million cover, breakdown recovery insurance services, unlimited mileage, service repairs during the rental period, provided they are not attributable to incorrect use. Fuel and other running costs will be borne by the Lessee.
3.3 The vehicle will be handed over with a full tank of fuel and should be returned in the same state. Otherwise a flat refuelling charge of € 15 gross plus € 0.20 gross per litre will be due in addition to the fuel costs for filling up the tank.
3.4 The daily rates are charged for each period of 24 hours commenced. Rental charges are always deemed to apply from the depot until receipt of the vehicle by the depot. One-way rentals are not possible. If the vehicle is returned after the time agreed in writing, we will charge a penalty of € 25 per hour commenced (maximum penalty for each overdue day is however the total daily charge). In addition, the Lessee is obliged to compensate the Lessor for the loss incurred as a result of late return, unless the Lessee is not responsible for the late return. In the event of late return the Lessor denies any continuation of the contractual relationship.
3.5 If the vehicle is returned before the end of the agreed rental period, the full, contractually agreed rental charge is to be paid. If the Lessor manages to rent out the vehicle elsewhere, the rental fee received from this rental will be credited against the rental charge, deducting a flat service charge of € 150.
3.6 The Lessee is liable for all fees, charges, fines and penalties accruing in connection with use of the vehicle, including the extent to which claims for them are levied against the Lessor, unless the Lessor is mainly responsible for the circumstance.

4. Booking, Cancellation and Rebooking
4.1 Unless the parties have arranged otherwise, the Rental Agreement refers to the selected vehicle group, but not to a specific vehicle type or a specific layout.
4.2 After the written confirmation of the booking is received, an initial payment of € 250 (bank transfer)| is to be made within 10 days. If the Lessee does not effect this payment within the period, the Lessor may terminate the Agreement. If the Agreement is terminated, the Lessee is obliged to pay compensation according to the cancellation charges provided for in clause 4.3. The Lessee is at liberty to prove that no loss or less loss has been incurred. The Lessor is at liberty to prove that higher loss has been incurred.
4.3 If the Lessee requires cancellation of the Agreement, the following cancellation fees will be due: up to 50 days before departure 10 % of the rental charge; from the 49th to 15th day before departure 50 % of the rental charge; from the 14th day 80 % of the rental charge; on the day the rental commences or upon failure to collect the vehicle: 95 % of the rental charge. The Lessee is at liberty to prove that no loss or less loss has been incurred. The Lessor is at liberty to prove that higher loss has been incurred. We recommend taking out a travel cancellation insurance policy.
4.4 Up to no later than 30 days before the originally agreed rental period begins, the Lessee may once select a vehicle from a different vehicle group, provided free capacities are available and the total rental fee is not reduced as a result. For this, an administration fee of € 50 per rebooking will be charged. Later rebookings are, if at all possible, only allowed following cancellation according to the conditions under clause 4.3 and subsequent new booking. There is no legal title to a rebooking or change of data.

5. Terms of Payment, Security Deposit

5.1 The security deposit of € 3,000 must either have been received on the Lessor's account, free of charge for the recipient, together with the remaining rental charge 21 days before the rental term begins, or must be deposited in cash on collection of the vehicle. For short-term bookings (less than 21 days to the rental date), the anticipated rental charge becomes due immediately, the security deposit no later than upon vehicle collection.
5.2 Following return of the vehicle, the rental depot will render the account for the security deposit and pay out the remaining sum, allowing for the claims ensuing from the Rental Agreement.
5.3 The rented object will be handed over only if, in addition to a rental fee to be paid in advance, the agreed security deposit is paid. This does not affect the obligation to pay the agreed rental fee.

6. Liability, Fully Comprehensive Insurance Cover
6.1 Should the vehicle be lost or damaged, or the Rental Agreement be breached, the Lessee is generally liable under the terms of the general liability regulations.
6.2 A release from liability is agreed between the contracting parties within the scope of a motor vehicle insurance policy with an excess of € 1,000.00 (part comprehensive cover) or € 3,000.00 (fully comprehensive cover). The Lessee is only liable for damage within the scope of this release from liability if he/she or his/her agents have not caused the damage through gross negligence or intent. The Lessee is also liable for damage
a) if, contrary to the Lessee's obligation pursuant to clause 8, he/she fails to submit notification of the damage to the Lessor by the required deadline or submits notification of the damage in incomplete form or containing incorrect details;
b) if he/she or his/her agents have failed to stop after an accident, have failed to report an accident to the police or have given incorrect details concerning the circumstances of an accident, insofar as this was detrimental to the Lessor's legitimate interests in ascertaining the damage, and this breach of duty is due neither to intent nor to gross negligence. In the event of breach of these obligations due to gross negligence, the release is upheld insofar as the breach has influenced neither the ascertainment of the insured event, nor the ascertainment or scope of the insurance benefit by the insurer behind the Lessor, nor the enforcement of claims for damages.
6.3 The release from liability does not apply to the agreed excess. It applies only to the rental period.
6.4 The release from liability (6.2) does not include, in particular, damage to brakes, operational damage and simple breakages, as well as damage caused by payload shifting or by maloperation (including furniture damage).
6.5 The regulations apply to the authorised user as well as to the Lessee. The contractually agreed release from liability does not apply to any unauthorised user of the vehicle.

7. Return Report, Reporting Faults, Prohibition of Assignment
7.1 The Lessee is required to return the vehicle in the condition stipulated in the Agreement.
7.2 The Lessee is required to immediately report to the rental depot any faults in the rental vehicle or its fittings discovered after the rental period has begun.
7.3. The Lessee may not make claims of any sort if the faults on which such claims are based are not recorded in writing and in detail in the Return Report.

8. Procedure in the Event of an Accident

8.1 In the event of an accident, fire, theft, damage caused by wild animals or any other damage, the Lessee is required to report the matter to the police and call in the police immediately. Claims of opposing parties must not be recognised.
8.2 Further, the Lessee is required to give the Lessor advance notification of the damage without delay. He is also required to fully inform the Lessor without delay, using the accident report to be found with the vehicle documents and to be carefully completed in full, so that the Lessor can fulfil its obligation to report the accident to the insurer within one week of the accident.

9. Repairs
9.1 The Lessee may authorise any repairs necessary to guarantee the operational and road safety of the vehicle up to a value of € 150 without prior consultation. Major repairs above this value may only be authorised with the consent of the rental depot.
9.2 The repair costs will be reimbursed by the rental depot on presentation of the relevant original receipts as well as the replaced parts, provided that the Lessee is not liable for the damage (see clause 6).
9.3 Damage claims for vehicle faults existing before the Rental Agreement was concluded and for which the Lessor is not responsible will not be recognised.

10. Authorised Drivers
10.1 The vehicle may only be driven by the Lessee himself/herself and those drivers named in the Rental Agreement, insofar as they are of the legal minimum driving age and in possession of a valid driving licence under the terms of clause 2.
10.2 The Lessee is required to record the names and addresses of all drivers to whom he/she gives the vehicle, including for any temporary period, and to inform the Lessor of these on request. The Lessee is responsible for the actions of each driver as for his/her own.

11. Prohibited Use
11.1 The Lessee is entitled only to customary use of the rented object. This does not include, in particular, participating in motor sport events and vehicle tests, transporting highly inflammable, toxic or otherwise dangerous substances, driving over unsecured terrain, committing customs offences and other criminal acts, even if such acts are subject to penalty based only on the law of the place where  the act is committed. The Lessee is prohibited from subletting the vehicle.
11.2 The vehicle is to be treated carefully, used for the purpose for which it is designed and to be duly locked. The regulations relating to use of the vehicle and technical rules are to be observed and maintenance intervals adhered to. The Lessee undertakes to carry out regular checks to ensure that the vehicle is in a roadworthy condition.

12. Smoking Ban / Transportation of Pets
Smoking inside the vehicle is allowed only if the Lessor has permitted smoking in the Agreement. This applies analogously to the transportation of pets or animals. Cleaning costs incurred by noncompliance as well as loss of profit due to the vehicle being temporarily unrentable as a result, will be borne by the Lessee.

13. Collection, Return
13.1 The Lessee is obliged to participate in a thorough introduction to the vehicle by our experts at the rental depot before the journey begins, and to follow return procedures together with the depot employees.
13.2 Collection: Monday to Friday 3 p.m. to 5 p.m.; Return: Monday to Friday 9 a.m. to 11 a.m. No collection or return is possible on Saturdays, Sundays or public holidays. Collection and return days are charged together as one day, provided altogether 24 hours are not exceeded. Before return of the vehicle, it must be cleaned properly inside by the Lessee. If this is not the case, the Lessee will be charged a flat-rate sum of € 149 for the cleaning costs. If it is necessary for the Lessor to also carry out partial or full cleaning of the toilet, the Lessee will be charged a flat-rate sum of € 180 for the cleaning costs. The return of the vehicle is confirmed by signature on the Return Report.
13.3 The rental depot can withhold the vehicle until the introduction to the vehicle has been carried out. Delays in collection and costs hereby incurred will be borne by the Lessee.

14. Replacement Vehicle
If no vehicle from the booked vehicle group is available or if the individually booked vehicle cannot be supplied at the rental depot, the Lessor reserves the right to provide a vehicle of similar size and similarly equipped, or a larger vehicle. In this case, no additional rental costs are incurred by the customer. If a smaller vehicle is offered and it is accepted by the Lessee, the price difference between the two vehicles will be refunded. If additional costs arise due to the use of the different vehicle, such as ferry and toll charges or running costs, which otherwise would not have arisen, these will be borne by the Lessee.

15. Travelling Abroad
It is possible to travel abroad with the motorhome within Europe. For travel in Eastern European and non-European countries, the prior permission of the Lessor must be obtained and special insurance cover must be taken out. Travel in war or disaster zones is prohibited.

16. Limitation of Liability

The liability for material defects for redress and rental reduction claims is limited to a maximum of 3 times the daily rental charge.

17. Term of Preclusion, Statute of Limitations
17.1 Claims due to non-fulfilment of the rental according to the terms of the Agreement must be made in writing to the rental depot by the Lessee within one month from return of the vehicle as contractually provided for. After expiry of this period, claims can only be asserted if failure to adhere to the date is not based on fault.
17.2 Contractual claims of the Lessee, also those arising from the breach of pre-contractual, postcontractual and incidental obligations by the Lessor, fall under the statute of limitations six months after the return as contractually provided for. If the Lessee has asserted such claims, the prescriptive period is suspended to the day on which the Lessor rejects the claims in writing.
17.3 The assignment of claims from the Rental Agreement to third parties, also to spouses or other fellow passengers, is excluded, as is the assertion of such claims in the Lessee’s own name.

18. Storage and Transfer of Personal Data
18.1 The Lessee consents to the Supplier and the associated rental depot storing his personal data.
18.2 The Lessor may pass on these data via the central warning ring and to third parties having a justified interest if the information given for rental is incorrect in important points, or the rented vehicle is not returned within 24 hours after expiry of the rental period (including any agreed extensions), or rental claims have to be asserted by means of legal collection proceedings, or if cheques issued by the Lessee are not honoured or bills of exchange are protested. In addition, data can be passed to all authorities responsible for the prosecution of regulatory offences and criminal offences if the Lessee has acted dishonestly or sufficient indication of this exists. This will take place if, for instance, false information is given for the rental, false personal documents or personal documents reported lost are presented, the vehicle is not returned, a technical defect is not reported, traffic offences are committed, and the like. Statutory obligations to pass on data are not restricted by this provision.

19. Jurisdiction
For all disputes arising from or relating to this Agreement, the place of jurisdiction is agreed as the registered office of the Lessor provided that the Lessee has no general place of jurisdiction in the country or after conclusion of the Agreement moves his place of residence or usual place of abode abroad or his place of residence or usual place of abode is not known at the time the action is filed, if the Lessee is a trader or a person as defined in § 38 para. 1 ZPO (German Code of Civil Procedure).

20. Final provisions
All agreements must be made in writing. Should any individual provision of these terms and conditions be or become void, illegal or unenforceable, the validity of the remaining provisions hereof shall not be affected. Any invalid provisions are to be reinterpreted so that they fulfil the purpose intended. Mandatory regulations remain unaffected and are agreed as such.

The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.


Enviro Wohnmobil Insurance

The daily rental charges include:
Part comprehensive cover with a maximum excess amount of € 1,000 and fully comprehensive cover with a maximum excess amount of € 3,000 per claim.
